These Terms of Use govern this website operated by Carson Dickey, an Idaho sole proprietor doing business as NextWave Strategies by Carson Dickey (“NextWave,” “we,” “us,” or “our”). By using the site, you agree to these terms. If you do not agree, do not use the site.

Website purpose; no engagement

The site provides general information about business-systems strategy and implementation and lets you request a conversation. Site content is not legal, financial, tax, cybersecurity, or other regulated professional advice. Sending a form, receiving a response, or scheduling a call does not create a client relationship or require either party to purchase or provide services. Any paid work requires a separate written agreement.

No promises of results

Business and technology outcomes depend on facts outside our control. Examples are illustrative, not promises, warranties, client results, or projections. Dashboards, workflows, metrics, alerts, testimonials clearly identified as examples, and business-chat demonstrations may use synthetic information. People remain responsible for reviewing decisions and outputs.

Your submissions

You represent that you may lawfully submit the information you provide. Do not send confidential third-party data, credentials, harmful code, or unlawful content. You retain ownership of your submission and give us a limited permission to store, process, and use it to evaluate and respond to your inquiry, operate and secure the site, and comply with law, as described in our Privacy Policy.

Limitation of liability

To the fullest extent permitted by law, NextWave and Carson Dickey will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, or goodwill, arising from use of or inability to use this site. For claims relating only to this free public website, total liability will not exceed the greater of $100 or the amount you paid to use the website. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

Governing law

These terms are governed by Idaho law, without regard to conflict-of-law rules. Any dispute concerning this website must be brought in a state or federal court with jurisdiction in Idaho, unless applicable law requires otherwise. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.

Changes and contact

We may update these terms by posting a revised version and effective date. Continued use after an update means you accept the revised terms.
